I cannot believe the number of divorces undergo our courts. It's a very tough time for spouses.

It's even more tragic when spouses stay together in a very unhappy house for years and years. That is not a pleasant way to live. Divorce is the proverbial band aid.

One result is there are many more divorce lawyers in business. The question is whether you should each hire divorce lawyers?

Lawyers aren't always necessary and in some cases aren't good because of the cost. If couples can work it out themselves, that is excellent.

1. A couple works on coming to an agreement on all the legal issues. If this doesn't work, move on to negotiation.

If you stave of litigation disaster at this stage, that is an excellent result. Wrapping it up is simply a matter of the paperwork. Be sure to get the terms in writing in an agreement.

2. Mediators: the best one can hope for other than reconciliation is a negotiated resolution. This can be achieved by hiring a divorce mediator.

If mediation works, the mediator can draft up an agreement for signing.

3. Each spouse hires an attorney but each instructs the attorney to focus on negotiation.

4. The spouses decide to hire an arbitrator knowledgeable about family law. The arbitrator hears the case and decides the issues.

This is good because you can get a mini-trial fast and it's cheaper than a full-blown trial. You can do it with or without a lawyer.

5. Court is the last resort. This can get ugly and you may end up with a result that is terrible. Avoid a trial if you can; however, sometimes you must go the distance.

As you can see there are many opportunities to get a divorce without an attorney. That said, if you're unclear about your rights or you aren't comfortable with how negotiations are going, visit a lawyer and get an opinion as to your rights.

You can talk to a lawyer without hiring one for full out litigation. Don't settle blind; however, don't spend the farm on a courtroom battle either - if it can be avoided.
